An East Lake man is due to appear in East Ridge Municipal Court, Tuesday, accused of raping his 14-year old physically challenged niece.

Paul Allen Davis, 40, of a 14th Avenue address, is currently in the Hamilton County Jail under a $150,000 bond. He was charged with Aggravated Rape and Incest.

According to an affidavit of complaint, on May 13 the victim went to the Red Bank police and told officers there that her uncle had raped her. The victim told authorities that the alleged incident occurred at the Knight’s Inn on Ringgold Road.

The victim told officers that she and her family were staying at the extended stay motel in February and March 2014 when the alleged incident happened.

According to the report, the victim said that one night she was awakened by Davis who was having intercourse with her. She said that Davis held her by her arms and would not let her up even after the act was complete.

Red Bank detectives interviewed Davis on May 13, the report states. After being advised of his Miranda Rights, Davis admitted to having intercourse with his niece at the East Ridge motel. The report states that Red Bank officers also had text messages between Davis and the the victim.

Those messages, the report states, detail Davis asking the victim not to tell her mother about the incident and offering to give the victim money and help her move.

The report states that the 14-year old victim suffers from a seizure disorder and has a partially missing arm. “These two factors contributed to her physical helplessness during the unlawful sexual penetration,” the report states.
